Deletion of Sections 69B, 69C, 69D and 69E

1. The Employment (Amendment) Bill 2021 ("the Bill") was presented on October 25, 2021.
2. Dewan Rakyat approved the Employment (Amendment) Bill 2021 on March 21, 2022.
3. Dewan Negara passed the Employment (Amendment) Bill 2021 on March 30, 2022.
4. The Employment (Amendment) Act 2022 was gazetted into law on May 10, 2022.

The Employment Act of 1955 (also known as "EA 1955") governs the procedures that are carried out in the "Court" known as the Labour Court.

The Director-General of Labour (abbreviated as DGL) is authorised by the Employment Act of 1955 (EA 1955) to consider matters relating to pay when a complaint is referred; hence, the 'Labour Court' was established.

According to Section 69 of the Employment Act of 1955, the DGL has the authority to inquire into and consider cases relating only to wage disputes that employees bring forward.

It is essential to keep in mind that the Labour Court can only consider cases brought forward by workers who are included in the First Schedule of the Employment Act of 1955.

These workers include employees whose salaries do not exceed RM2,000 and manual workers.

The DGL was also granted the authority by the EA 1955 to hear complaints concerning employees whose monthly wages do not exceed RM5,000.

This power was granted to the DGL under s 69B of the existing EA 1955.

Disputes about the non-payment of salary and/or non-payment of termination benefits are among the most typical types of cases that are heard in the Labour Court.

2. As a direct result of the deletion of section 69B, sections 69C, 69D, and 69E that corresponded to it was also deleted.

3. As a result of the deletion of sections 69B, 69c, 69D, and 69E of the Employment Act 1955, many people believe that in the future, only employees listed in the First Schedule of the Employment Act 1955 will be eligible to complain to the Labor Department in the event of a wage dispute and that employees whose salary exceeds RM2,000 will no longer be eligible to do so.

4. However, according to the Ministry of Human Resources, the government will make subsequent amendments to the First Schedule of Act 265 through an order that will be issued by the Minister of Human Resources in accordance with the powers conferred by Section 2(2) of Act 265.

5. This will be done in order to ensure that all salaried persons in the country have access to the minimum benefits and protections that are outlined in Act 265.
