1. Except for s 14, para 26(a), s 45 and 47, para 48(a), s 55, and para 57(b), the Patents (Amendment) Act 2022 went into effect on March 18, 2022. At the same time as the Amendment Act came into operation, two pieces of subsidiary legislation were issued and entered into force, namely:
👉 Patents (Amendment) Regulations 2022 [P.U.(A) 68/2022]; and
👉 Patents (Amendment of Second Schedule) Order 2022 [P.U. (A) 63/2022]
2. The Patents (Amendment) Act 2022 aims to bring our country's patent laws into step with international developments in intellectual protection.
3. The amendments reflect Malaysia's commitments under:
👉 the TRIPS Agreement (on public health),
👉 the Regional Comprehensive Economic Partnership Agreement (RCEP), and
👉 the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP),
👉 as well as compliance with the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for Patent Procedure Purposes.

1. 除第14条第26(a)条，第45条和第47条第48(a)条，第55条和第57(b)条外，2022 年专利(修正)法令于2022年3月18日正式生效。在《修正案》通过的同时，两部附属立法也已颁布并生效，即:
👉 2022 年专利(修正)条例 [P.U.(A) 68/2022]; 和
👉 2022 年专利(第二附表修正)指令 [P.U. (A) 63/2022] 。
2. 2022年专利(修正)法令旨在使我国的专利法与国际知识产权保护的发展趋同。
3. 修正法令反映了马来西亚在以下方面的承诺:-
👉 与贸易有关的知识产权协议 (关于公共卫生)；
👉 区域全面经济伙伴关系协定 (RCEP)；
👉 跨太平洋伙伴全面和进步协议 (CPTPP)；
👉 以及遵守《关于国际承认用于专利程序的微生物保存布达佩斯条约》。
