1. The Employment (Amendment) Bill 2021 ("the Bill") was presented on October 25, 2021.
2. Dewan Rakyat approved the Employment (Amendment) Bill 2021 on March 21, 2022.
3. Dewan Negara passed the Employment (Amendment) Bill 2021 on March 30, 2022.
4. The Employment (Amendment) Act 2022 was gazetted into law on May 10, 2022.

However, [As of 13-5-2022] the Act has not yet come into force.

1. 《2021年就业(修订)法案》("法案")于2021年10月25日在国会提交。
2. 下议院于2022年3月21日批准了《2021年就业(修订)法案》。

A salary advance is when your employer agrees to give you a portion or the entirety of a future salary before your usual payday.


According to section 22 of the Employment Act of 1955, "An employee may only request an advance in the amount that does not exceed the employee's salary in the preceding month." 


In less legal terms, this means that you are only allowed to claim an advance of no more than the last salary you drew.


预支工资是指你的雇主同意在你日常的发薪日前,提前给你部分或全部的未来的工资。


根据《1955年劳工法令》第22条,"雇员只能要求不超过其上个月工资的预支金额"。 


用术语来说,这意味着雇员只能向公司申请不超过一个月工资(其最后一次提取的工资数额)的预支。



But what if the advance you need is more than one month of your salary?

1. Some of the most significant amendments suggested to the Employment Act 1955 as a result of the Employment (Amendment) Bill 2021 ("the Bill") include Amendment of Section 22 – Limitation on Advances to Employees


👉 The amendment extends the definition of “immediate family members” to the spouse as follows:-


For the purposes of this section, "immediate family members" means the employees' parents, spouse, children, siblings or any other person under the employee's guardianship.

According to section 22(1) of the Employment Act of 1955, "monetary advances to employees can exceed the aggregate rate of salary which the employee earned in the prior month if such advance is granted to the employee to enable him to purchase:

to enable him to purchase a house or to build or improve a house;
to enable him to purchase land;
to enable him to purchase a motorcar, a motorcycle or a bicycle;
to enable him to purchase shares of the employer's business offered for sale by the employer;
to enable him to purchase a computer;
to enable him to pay for medical expenses for himself or his immediate family members;
to enable him to pay for daily expenses pending receipt of any periodical payments for temporary disablement under the Employees’ Social Security Act 1969 [Act 4];
to enable him to pay for educational expenses for himself or his immediate family members;
for any other purpose --
(i) in respect of which an application in writing is made by the employer to the Director-General;
(ii) which is, in the opinion of the Director-General, beneficial to the employee; and
(iii) which is approved in writing by the Director-General, provided that in granting such approval, the Director-General may make such modifications thereto or impose such conditions thereon as he may deem proper;
for such other purpose as the Minister may, from time to time, by notification in the Gazette, specify either generally in respect of all employees, or only in respect of any particular employee, or any class, category or description of employees.

For the purposes of this section, "immediate family members" means the employees' parents, children, siblings or any other person under the employee's guardianship.

为任何其他目的 --
(i) 由雇主向总监提出书面申请的
(ii) 总监认为对该雇员有利的;以及
(iii) 由总监书面批准,但在批准时,总监可对其进行修改或施加其认为适当的条件
部长可能不时通过在《宪报》上发布的通知所规定的其他目的,就所有雇员,或仅就任何特定类别、类型或种类的雇员。
