Updated Guideline on Real Property Gains Tax


The Inland Revenue Board of Malaysia has released a new Real Property Gains Tax (RPGT) guideline on its website. Dated 6 January 2023, the guideline is written in Bahasa Malaysia.


It clarifies the scope of imposition, calculation of RPGT, exemptions, and the responsibilities of the disposer and acquirer in the disposal of chargeable assets in Malaysia.


The guideline considers amendments to the RPGT Act 1976 and the Finance Act 2021 [Act 833].


It should be noted that the information provided in the Guidelines on RPGT dated 13 June 2018 or 18 June 2013 (whichever is applicable) still applies based on the provisions of the RPGT Act 1976 that are in force on the date of disposal of the said asset.


The new guideline will be useful for taxpayers and professionals involved in disposing of chargeable assets in Malaysia.
