1. The Employment (Amendment) Bill 2021 ("the Bill") was presented on October 25, 2021.
2. Dewan Rakyat approved the Employment (Amendment) Bill 2021 on March 21, 2022.
3. Dewan Negara passed the Employment (Amendment) Bill 2021 on March 30, 2022.
4. The Employment (Amendment) Act 2022 was gazetted into law on May 10, 2022.

However, [As of 13-5-2022] the Act has not yet come into force.

[In force means that the Act or the secondary legislation has the force of law.]

1. According to ILO Convention 183, Article 8(1):


  • It shall be unlawful for an employer to terminate the employment of a woman during her pregnancy or absence on leave referred to in Articles 4 (maternity leave) or 5 (leave in case of illness or complications) or during a period following her return to work to be prescribed by national laws or regulations, except on grounds unrelated to the pregnancy or birth of the child and its consequences or nursing.


  • The burden of proving that the reasons for dismissal are unrelated to pregnancy or childbirth and its consequences or nursing shall rest on the employer.


2. According to ILO Convention 183, Article 8(2):


  • A woman is guaranteed the right to return to the same position or an equivalent position paid at the same rate at the end of her maternity leave.

Some of the most significant amendments suggested to the Employment Act 1955 as a result of the Employment (Amendment) Bill 2021 ("the Bill") include New Section 41A - Restriction on Termination of Pregnant Female Employee 👉 The Bill proposes to prohibit the dismissal of a pregnant employee or an employee suffering from a pregnancy-related sickness, except for reasons of misconduct, willful breach of the employment contract, or business closure. 👉 The employer bears the burden of establishing that the termination was not driven by pregnancy or sickness associated with pregnancy. 🌻🌻🌻🌻🌻🌻🌻🌻
