1. The Employment (Amendment) Bill 2021 ("the Bill") was presented on October 25, 2021.
2. Dewan Rakyat approved the Employment (Amendment) Bill 2021 on March 21, 2022.
3. Dewan Negara passed the Employment (Amendment) Bill 2021 on March 30, 2022.
4. The Employment (Amendment) Act 2022 was gazetted into law on May 10, 2022.

However, [As of 16-5-2022] the Act has not yet come into force.

[In force means that the Act or the secondary legislation has the force of law.]

What is forced labour?

Forced labour can be understood as work that is performed involuntarily and under the menace of any penalty.

It refers to situations in which persons are coerced to work through the use of violence or intimidation, or by more subtle means such as manipulated debt, retention of identity papers or threats of denunciation to immigration authorities.




The Definition of forced labour

According to the ILO Forced Labour Convention, 1930 (No. 29) , forced or compulsory labour is:

"all work or service which is exacted from any person under the threat of a penalty and for which the person has not offered himself or herself voluntarily."




The Forced Labour Protocol (Article 1(3)) explicitly reaffirms the definition.

This definition consists of three elements:

  1. Work or service refers to all types of work occurring in any activity, industry or sector including in the informal economy.

  2. Menace of any penalty refers to a wide range of penalties used to compel someone to work.

  3. Involuntariness: The terms “offered voluntarily” refer to the free and informed consent of a worker to take a job and his or her freedom to leave at any time. This is not the case for example when an employer or recruiter makes false promises so that a worker takes a job he or she would not otherwise have accepted.

2. New section 90B to provide for the offence of forced labour

3. Any employer who threatens, deceives, or forces an employee to do any activity, service, or work and prevents that employee from proceeding beyond the place or area where such activity, service or work is done, commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both.

4. The purpose of this Act is to bring the Employment Act 1955 into line with the requirements of the International Labour Organisation ("ILO"). The ILO indicators can therefore be used as a reference to determine what may constitute forced labour. These indicators include restrictions on freedom of movement, overtime work, withholding of wages or identity documents, physical or sexual violence, threats and intimidation.
