These are the Excise (Amendment) (No. 2) Regulations 2023, made by the Minister under section 85 of the Excise Act 1976 [Act 176].
The regulations came into operation on 1 January 2023.
Regulation 2 of the Excise Regulations 1977 [P.U. (A) 161/1977] is amended by deleting the definition of "form".
Sub-regulations 4(1) and 10(1) of the principal Regulations are amended by substituting the words "the form and manner as determined by the Director General under" for "Form JKDM No. 1" and "Form JKDM No. 3", respectively.
Regulation 22 is substituted with a new regulation requiring licensed manufacturers of tobacco products to keep an entry book, register, delivery book, and waste stock book in a form and manner as determined by the Director General.
Sub-regulation 28(4) is deleted, while regulation 29 is amended to allow for forms to be determined by the Director General.
Similarly, regulation 29A is amended to require a declaration in a form and manner as determined by the Director General and for the proper customs officer to authorise the removal of goods.
Regulation 31 is amended to allow for forms and manner as determined by the Director General for removing dutiable goods from licensed premises under section 20, licensed warehouses, warehouses or other places approved by the Director General under the Act.
